Entering the seventh period of government, Indonesia sustains a different political situation where the executive and the legislature controlled by two different coalitions. This interesting enough, the recent situation comes as a new dynamics of politics development of this country. As history recorded, for the first time the executive and legislative board held by a different party coalition. In New Order era, neither the executive, legislative or even judicial branches are controlled by one party that is Golkar. Similarly, when the SBY lead below the cabinet of Indonesia Bersatu, executives and legislative also ruled by the Democratic party. That is why this whole situation leads in to new color of political history.

The fierce competition between both coalitions, KMP (Koalisi Merah Putih) and KIH (Koalisi Indonesia Hebat) begin since the election of new president of 2014-2019 periods. Both coalition sides bring Indonesia to its acrimonious political era. This can be seen from the result of presidential election which is very slightly different. KIH outperform KMP with the result of 53.15% and 46.85%, which means Jokowi-JK comes out as a winner (cited from KPU.go.id). Factually, that coalition which consisted of PDIP, PKB, NASDEM, HANURA, and PKI still cannot breathe, there is still the realm of the legislative and judicial branches that can still be controlled by its political opponents.

As if does not want to lose the executive stage, the fierce competition between two coalition is not only happening in the executive stage, but also in the legislative and judicial branches. The selection of legislative leaders of DPR and MPR were re-heated. KMP begins to show its fangs, as the case didn’t want to defeat twice. The solidity of that coalition seems strengthened, and in finally the important legislative and judicial branches were absolutely dominated by a coalition occupied by Gerindra, PKS, PAN, PBB, and Gorlkar.

Despite of this KIH dominate the government officially, but it does not prevail in term of constitution. This fact is reinforced by the latest legalization of UU MD3 where one of the local government election conducted by DPR, while the majority of the legislative coalition dominated by KMP. This will narrow the executive authority that has been ruled by KIH. The adoption of UU MD3 strengthens the spirit legislature that includes the MPR, DPR, DPD and DPRD.

That phenomenon strengthens the spirit of the UU MD3 legislature in its function as checks and balances that include executive functions of legislation, budgeting, and supervision. One of the strong authorities of Parliament listed in the UUD MD3 verse 74. This allows KMP to command not only legislative but also the scope of the executive at the provincial level.

If we talk about the 1945 legislature, it seems favoring the legislative board when it confronted with the executive, in this case the president. In 1945 verse 7A is stated, ” Presiden dan/atau Wakil Presiden dapat diberhentikan dalam masa jabatannya oleh MPR atas usul DPR, baik apabila terbukti telah melakukan pelanggaran hukum berupa pengkhianatan terhadap negara, korupsi, penyuapan, tindak pidana berat lainnya atau perbuatan tercela maupun apabila terbukti tidak lagi memenuhi syarat sebagai presiden dan/atau wakil presiden”, while verse 7C stated, “Presiden tidak dapat membekukan dan/atau membubarkan DPR”. With those conditions, the position of president will be very weak. The government’s RAPBN and RKAKL allows for KMP held tough as it is possible to criticize many proposals and government programs, and KMP will be able to play a central legislative and executive areas in the region.

Probably Jokowi’s cabinet will not stay “calm” with the possibilities above; his political strategy sometimes seems unpredictable. It could have been strengthened by his extra-parliamentary politics by his community and student supporters, considering he is one president who is so popular among the community, especially in the media.

However, truthfully politics is not a contest of power of both coalitions. It is more precisely if both coalitions be challenged to continue to work synergistically, rule out the group prominence, and be more pro-public. Will this be a stronghold of both sides of “checks and balances” that is dynamic, and still comes down to the good and welfare of the people in this lovely state?  It is kind of rhetorical questions that can be answered only by both of parties (AK).

Recently, a new legislation draft of regional election has become a rising up issue. This new legislation draft come as new solution to overcome the obstacles found in direct-regional election such as governer election and mayoral election. Those elections considered as problematic election, many cases found such as soaring political cost, inevitable transactional politic, dinasty politic, and a dowry practice politic which seem commonly happen in the field. Direct election judged as a profligacy because of it spending a high cost, and acquire high potency of corruption’s cases. Due to those considerations these draft developed as a new resolution. Inspite of many people judged it as “trick” of one of coalition to defend its political bargaining position.

Factually those matters are not that simple to be solved. This draft appear as a new controversy. Indonesia known as republic country which site its citizenry as the most important constituent. Thus, direct electional system judged as the most democratic and suitable system for this Republic-Presidential country. This transmution of election system-from direct to indirect assesed as a democracy deflation. The citizenry are no longer directly involved in the selection of their goverment leader. Especially after the reform era wher the citezenry seem have more power than in previous era. It gives impact to the citezenry’s maturity development of democracy which will be hindered. On the other hands, the goverment should facilitate its citizens to provide a better politic education, and one of the way is direct election.

Beyond that, both of the systems are have its own pro-cons. Apart from those analysis, there’s something unique side of this controversy. The choice of giving back the authority to DPRD to choose the mayoral and governor has a positive value. This in line with the basic constitution of Pancasila number 4, which stated “Kerakyatan yang dipimpin oleh hikmat kebijaksanaan dalam permusyawaratan perwakilan”. It means that democracy not always in directly-hands on-election. There is another mechanism of consultative representative.

This consultative representative is another form of Syuro system in Islamic system through syuro olh ahlul halli wal ‘aqdi mechanism. According to Azzam (1979) in his book “Pemerintahan Islam”, he describe a consultative representative system-known as majlis asy-syura, it has a fuction as legislative where it has to be representative of society in order to make a decision which valid for whole citizen. This phenomenon give a big picture of a representative democrcy itself. Not all democracy has to be directly choosen from the society, but there is another type of representative democracy. So if this system called as a deflation of democracy, is it appropriate? You can answer by yourself.

But the big question is, Have the system compatible with the current condition of Indonesia? The civil society of this county hasn’t mature yet. Both of direct and indirect election might be risky. If it has to stand with direct election system, there are so many task for KPU and other parties. Furthermore, there must be a transition rule that states all the elections simultaneously from central to local, executive and legislative. there must be a technical improvement of the election, limiting campaign finance, and a centralized campaign schedule in order to avoid the problem which has been stated above. Meanwhile, if it has to be in indirect election system, it might be a new challenge and healthy competition  for all politic parties. They have to increase the capacity of each representative in legislative seat. There must be a strict requirements and rule in selecting the next goverment leaders to avoid the monopoly of one particular political party or coalition (AK).

This is my very-first time meeting with my supervisor again after my thesis-judgement day, then…

me: “Asalamualaikum sir, may i……”

my supervisor: “walaikumsalam, no no tika i won’t make you cry again

                         i just want to take take care of you know haha”

me: “hehe, i won’t do that again, i won’t cry again sir” (smiling)

Those conversations reminds me of the moment several time ago, the “epic” part of my Skripsweet story. Never cross in my mind that i can reach until this part, the end of the story. I’ve been crying for a long time at that time. It feels so hard to keep struggle and tough. But Allah never bring you this way without any purpose. 

Thanks sir, thanks to teach me about the real-challanging life. Nothing great income without any hard effort, we have to pay something with another thing. Those littres of tears teach me how to be strong, how to start something back from zero point, how to be thankful in every part of my life, no matter how hard it is. 

Everything happens for a reason. But your task is find that reason, and you’ll be happiest man in this world.

Repost dari status salah satu teman. Seperti pengingat diantara waktu-waktu ini. Ya hanya sangat sedikit orang bersabar dan bertahan memikul amanah kebaikan dipundaknya. 

Itulah alasan mengapa kau tak boleh bertanya lagi. “Kapan saya boleh istirahat, bisa hibernasi setelah kemaren ga tidur2”, “kapan bisa leha-leha, kan saya udah ga kuliah”. Dan semakin terasa berat beban itu setelah pergantian status itu terjadi. 

Jannah itu mahal, tak cukup hanya dengan ibadah untuk diri sendiri. Hanya orang-orang yang sedikit itulah yang layak menerimanya dengan cuma-cuma. All you have to do is be patient till your time is over. Be strong, Allah with you!

Berbuatlah hingga kelelahan itu lelah bersamamu, bergeraklah hingga kejenuhan itu jenuh bersamamu.
